All Land Use Permits expire Two (2) Years from the date of issuance if construction or use has not begun. Sanitary Permit
issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without .,
permit will result in penalties.
The local Town. Village, City, State or Federal agencies may also require permits. The new cormmctioa of one- & two-Gmil
dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one -

Hi,
I'm not sure if you saw the earlier emails, but there was a mix-up due to a tax ID number that is almost
identical to an address, both of which are projects that you are working on. We initially thought we were
inspecting the Marcusen property (2640), but we were actually on tax ID 26400, owned by Chase Nordby.
I've spoken with Chase, and he will be reaching out to you regarding the lack of erosion control (silt
fences, etc.) at the site.
A few key questions:
• Have you contacted the DNR to confirm whether this project is exempt from individual permits?
• Are you planning to keep the level bench at the top of the riprap?
• Can you provide detailed plans showing how the toe rock was installed and elevations relative to
the ordinary high-water mark? The current hand -drawn submissions lack this information.
Please let us know how you plan to complete the project and install erosion control as soon as possible
as the ground thaws.

• Level Bench: The existing bench along both properties is not permitted as is. It must be graded to
ensure a smooth transition from the waterline to the top of the bluff. Currently, the exposed bluff
is highly erodible and cannot be left in this state.
• Erosion Control: No erosion control measures are in place, leaving the site vulnerable to erosion
and runoff into the lake. This must be addressed immediately.
• Neighbor's Property: Please clarify how much of the project extends onto your neighbor's
property. If work was done there, we will need a permit from the property owner.
If anything is unclear, I can provide marked -up photos from my site visit.
To proceed, we need the following details before issuing a permit:
• Length of riprap along the shoreline
• Height above the ordinary high-water mark and method used to determine it (Army Corps datum
or natural)
• Wave run-up calculation (if applicable)
• Access road construction details, including whether all rock was removed after placement and its
width
• Plans for the level bench along the shoreline
Olson Brothers must provide this information. I have copied them on all correspondence but have not yet
received a response.

Anyway, yes. If there's anyway you can start sorting this out with Olson Bros directly, that would be great.
We can paythe fee, but we aren't contractors or engineers, so don't have much of the other info. The
length of the project wasn't long. I believe Olson Bros told us since you recently contacted us that it
doesn't need the DNR permitting, because it was under a certain number of feet. Just your county
permits?
When we bought the house, rock work had been done in front of the house and in front of our neighbors',
but not in between. I'm not sure if that was maybe because nobody knew where the property lines were

Well, we just had a very bizarre snafu. Your tax ID is 26400 and we have another riprap project we are
working on with the address 2640 very close by on HWY 13 (also done by Olson Brothers). When we went
on to that property, we thought it was yours due to that similarity.
So, you can disregard the points on the erosion control and the level bench at the top of the riprap. We
will need to another trip to inspect your property. Again, disregard the points on the erosion and the
bench, but we will still need the detailed plans I had addressed.

Thanks for the update regarding the previously installed riprap on both properties. I will need to
determine whether those installations were permitted to see what the exact projects entailed.
We recently visited your property while inspecting another riprap project in the area. There are serious
concerns that must be addressed before we can issue a permit. Based on what we observed, the project
does not appear to be exempt from DNR review. To confirm, we need detailed plans outlining the scope
of work, as mentioned in my earlier email.
Key issues that need immediate attention:

estimate to get the rock work done between our properties. This is because he was worried about
erosion and losing his house down the road. We are contacting Olson Bros so hopefully they can work
with you to get this sorted out.

In reference to the questions on the shoreland grading permit. APR 082025
Ra;eld Co Zoning Dept.
There were 388 tons of rock placed on fabric to tie approximately 110' of unprotected
shoreline with neighboring existing placement.
The rock is 6-8 feet above the high watermark based on natural high-water mark.
Matching the previously placed shoreline riprap was used not the wave run-up calculation.
The access road was only cleared of brush and small trees, work was done during while the
ground was frozen and no rock was needed on access.
The finally grading, seeding and e -mat will be done as weather permits.

Charles and Marjorie Sigmund are hereby granted under Section 30.12(1), Wisconsin Statutes, a
permit to place riprap on the bed of Lake Superior, Town of Orienta, Bayfield County, also
described as the Gov't Lot 3 S35, T50N, R9W, subject to the following conditions:
1. You must notify John Spangberg at phone 715-685-2923 before starting construction and
again not more than 5 days after the project is complete.
2. You must complete the project as described on or before June 15, 2008. If you will not
complete the project by this date, you must submit a written request for an extension prior to
the expiration date of the permit. Your request must identify the requested extension date
and the reason for the extension. A permit extension may be granted, for good cause, by
the Department. You may not begin or continue construction after the original permit
expiration date unless the Department grants a new permit or permit extension in writing.
3. This permit does not authorize any work other than what you specifically describe in your
application and plans, and as modified by the conditions of this permit. If you wish to alter the
project or permit conditions, you must first obtain written approval of the Department.
4. You are responsible for obtaining any permit or approval that may be required for your project
by local zoning ordinances or by the U.S. Army Corps of Engineers before starting your
project.
5. Upon reasonable notice, you shall allow access to your project site during reasonable hours to
any Department employee who is investigating the project's construction, operation,
maintenance or permit compliance.
6. The Department may modify or revoke this permit if the project is not completed according to
the terms of the permit, or if the Department determines the activity is detrimental to the public
interest.
7. You must post a copy of this permit at a conspicuous location on the project site, visible from
the waterway, for at least five days prior to construction, and remaining at least five days
after construction. You must also have a copy of the permit and approved plan available at
the project site at all times until the project is complete.
8. Your acceptance of this permit and efforts to begin work on this project signify that you have
read, understood and agreed to follow all conditions of this permit.
9. You must submit a series of photographs to the Department, within one week of completion
of work on the site. The photographs must be taken from different vantage points and
depict all work authorized by this permit.
10. You, your agent, and any involved contractors or consultants may be considered a party to
the violation pursuant to Section 30.292, Wis. Scats., for any violations of Chapter 30,
Wisconsin Statutes or this permit.
4. The proposed project, if constructed in accordance with this permit wilhvet aversely ffect
water quality, will not increase water pollution in surface waters and will not cause:vs
environmental pollution as defined in s. 283.01(6m), Wis. Stats.
5. The proposed project will not impact wetlands if constructed in accordance with this permit.
6. The Department of Natural Resources and the applicant have completed all procedural
requirements and the project as permitted will comply with all applicable requirements of
Sections 1.11, 30.12(1), Wisconsin Statutes and Chapters NR 1, 102, 103, 115, 116, 117,
150, 299 and NR 328 of the Wisconsin Administrative Code.
CONCLUSIONS OF LAW
1. The Department has authority under the above indicated Statutes and Administrative Codes,
to issue a permit for the construction and maintenance of this project.
NOTICE OF APPEAL RIGHTS
If you believe that you have a right to challenge this decision, you should know that the
Wisconsin statutes and administrative rules establish time periods within which requests to
review Department decisions shall be filed. For judicial review of a decision pursuant to
sections 227.52 and 227.53, Wis. Stats., you have 30 days after the decision is mailed, or
otherwise served by the Department, to file your petition with the appropriate circuit court and
serve the petition on the Department. Such a petition for judicial review shall name the
Department of Natural Resources as the respondent.
To request a contested case hearing pursuant to section 227.42, Wis. Stats., you have 30 days
after the decision is mailed, or otherwise served by the Department, to serve a petition for
hearing on the Secretary of the Department of Natural Resources, P.O. Box 7921, Madison, WI,
53707-7921. The filing of a request for a contested case hearing is not a prerequisite for judicial
review and does not extend the 30 -day period for filing a petition for judicial review.
A request for contested case hearing must follow the form prescribed in section NR 2.05(5),
Wis. Adm. Code, and must include the following information:
1. A description of the Department's action or inaction which is the basis for the request;
2. The substantial interest of the petitioner which is injured in fact or threatened with injury
by the Department's action or inaction;
3. Evidence of legislative intent that this interest is hot to be protected;
4. An explanation of how the injury to the petitioner is different in kind or degree from the
injury to the general public caused by the Department's action or inaction;
5. That there is a dispute of material fact, and what the disputed facts are;
6. The statute or administrative rule other than s. 227.42, Wis. Stats., which accords a right
to a hearing.

1. Primary/ install60 feet of rock riprap on West side of property, re -grade
slope in area- of rock riprap.
2. Secondary/ install yard drain, 100 feet long by 2 feet to 4 feet wide,
Starting from west property line Eastward.
Rock riprap will be 60 feet wide by 15 feet to 20 feet tall, 400 to 800 pound
filter stone and 2 to 4 ton armor stone, geotextile under stone.
Slope will be re -graded; erosion mat and seeding will be placed on re -graded
slope. Filter fence will be installed as required.
Subsurface yard drain will be about 100 feet long and 2 feet to 4 feet wide, 6
feet to 10. feet deep.
Work will be done when site dries up, June, July or August of 2005.
Any excess soil from the bank re -grading will be disposed off site.

Thank you for contacting the Wisconsin Department of Natural Resources.
Enclosed are the_ project application materials you have requested.
• The Wisconsin Department of Natural Resources helps protect your rights in public waters as well as public safety, by ensuring
adequate planning and design of projects affecting fish and wildlife habitat, water quality and natural scenic beauty. This is
done through permit and plan approval requirements for individual water projects. Chapters 30 and 31 of the Wisconsin
Statutes require written permits for certain activities on or near a waterway.
Before submitting this application for. a miscellaneous structure permit, please contact your county, city or village zoning
department to find out if your project site is in either a mapped wetland or floodplain and if local zoning requirements
could affect your project. Please see the Wetland Information topic (found in the Waterway and Wetland Permits Web
Page) or request Wetland Packet #20 in addition to this packet for details.
'A complete application with detailed drawings will help us make a decision about your application for permit.- The

All applications require the following information on the application form and plan drawing sheet supplied or on
additional sheets if necessary.
1. A copy of your deed or similar proof of ownership (e.g. land contract, current property tax receipt).
2. Good photographs that clearly show the existing project area. Remember, too much snow cover or vegetation may
obscure important details. If possible, have another person stand near the project area for size reference.
3. Five (5) copies of a completed application- Form 3500-53P including applicant information page and project
plans. When completing your application, please use a ballpoint pen with black ink. .The site location sketch and
plan drawings should be clear and to scale and have enough detail to find the site and understand the project proposal.
Make sure your phone number (both business and home) and property address or fire number is on the
application. Plans may be submitted on a separate page(s), but please submit five (5) copies.
4. Five (5) copies of a narrative description of your proposal, on a separate blank page. Please state:
- what the project is,
- how you intend to carry out the project, including methods, materials and equipment,
- your proposed construction schedule and sequence of work,
- what temporary and permanent erosion control measures will be used, and
- the location of any disposal area for dredged or excavated materials.
5. Five (5) copies of site maps. Provide copies of relevant maps (when possible), such as USGS topographic map,
Wisconsin Wetland Inventory map, FEMA floodplain maps, soil or zoning maps, with the project location clearly
identified.
6. The appropriate application fee (complete Form 3500-53A).
Please select the scale of the drawing carefully to fit all the necessary information on the plan drawing sheet. If necessary, use
additional sheets. Be sure to draw all the plans as accurately as possible. The Department may require additional information to
evaluate the project.

State law requires that the Department charge a fee for processing your request to make changes to surface waters
and wetlands. Each application requires the correct fee in order for review to begin. Please review the application
information for the activity you plan in order to determine whether it is eligible for a general permit (GP)to
determine the correct fee.

After exemption determinations and general permit deadlines are met, individual applications are reviewed
on a first in - first out basis (information on current average decision times is available on request). We will do
our utmost to review your application and deliver a decision promptly.
An expedited decision process is available for a supplemental fee of $2000. The expedited permit review
guarantees a decision by an agreed -upon date. If you wish to request an expedited permit review, submit a letter
with your application describing the time frame that will meet your needs, along with a check for the applicable
permit fee and a separate check for the supplemental $2000 fee. (The supplemental fee funds permit reviewers
specifically designated for expedited.decision-making). Within twenty days we will respond in writing, specifying
any additional information needed for an expedited. decision on your proposal, and the date by which we can make a
decision once the application is complete.
Refunds of standard fees are made only if the refund is requested before we determine that the application is
complete. Supplemental fees will be refunded if a decision is not made by the agreed -upon date.
After -the -fact applications, for permits or approvals submitted after work has been commenced or completed,
require twice the usual fee. After -the -fact general permits are not available. Projects started or completed without
obtaining the appropriate permits are subject to potential enforcement actions (e.g. monetary forfeitures or
mandatory abatement).
Personally identifiable information on this form is not used for any other purpose than filing of this application but
it may be made available to requesters under Wisconsin's open records law [s. 19.31-19.39, Wis. Stats.].

RE: Erosion Control
The erosion that is taking place at your residence near Port Wing, WI., is due to a
combination, of events. The largest problem is due to subsurface moisture exiting the
bank in different locations and causing the face of the slope to slump / slide down the
bank. This can be controlled by a sub surface drain system that can be installed to divert
the moisture to a desired location. The influence of surface water draining off the
property and roof are adding to the problem. Either directing this moisture to the drain
ditch or re -contouring your lakeside yard to divert this surface water to a specific location
will greatly reduce this influence. The final issue that is finishing the sequence is the
wave action of Lake. Superior continues to under cut the bank, this can be reduced by
• installing a proper stone revetment.
Below is a price breakdown for the required work that is mentioned above, please
• note that this work can be completed over a period of time, however a mobilization cost
will have to be incurred each time we move on your site.

The following is an estimate for shoreline erosion repairs on your property at 5370 St.
Hwy. 13 — Bayfield County, WI:
The slope will be shaped from the shoreline to the top. Rock will be placed at shoreline
from existing rock 60' west to property line, approximately 15' high.
Slope will be seeded and erosion mat placed on slope.
Drain tile will be installed where it is needed. That would be determined when we are on
the project. The cost of the drain tile would be $3.50 per foot plus the cost for the
excavator.
Approximately 260 ton of rock would be used. Fabric would be placed underneath the
rock. Cost of the rock is $11.50 per ton.
Olson Bros. estimates the cost of this project to be: $12,988.00
