The location of this property is within the unincorporated village ofComucopia, is serviced by the Town Of Bell Sanitary District, and so meets the requirement for waiver requests under 13-l-42c (4) and 13-l-29b (3 a) A) We respectfully request that the requirements for an Environmental Impact Analysis under 13-1- 42 (2) be waived. • This property has had a structure on it for 70 years, long before the current zoning requirements. • After the motel closed in the early 2000's, the building began to decay and was an eyesore and health hazard to occupants due to mold. The owner at the time received many complaints from the locals to clean it up. • Our renovation utilized the same foundation, and so little soil was disturbed during the rebuild. • There has been no addition of'impervious surface', and in fact we tore out some old sidewalk to create more green space. • The surrounding soil is sand which absorbs rain runoff. (Pine trees are doing well, the grass not so much) • Current use is during the summer, with very limited shoulder season use. • Parking is on town roads or as provided by our neighbors who have a gravel lot. (Less parking on site than when it was a motel) • The updated structure has a 7.2mw grid-tied photovoltaic system, providing more than half of all needed electricity for heating and cooling. (B) We respectfully request the requirements for open space under 13-1-29 be waived. • Note that our lot size/open space is larger than outlined on the zoning map. The zoning map shows the parcel setbacks including an easement that LCHoldings provided the seller as a promise to not block that space for their parking area. The seller was required to do this so that both properties met lot size requirements. • The Village ofComucopia provides ample open space. Across the street is Town property, along with several hundred feet of beach on Siskiwit Bay. Within walking distance we have Siskiwit Falls and County Forest. There is also a park at the beach with playgrounds, etc. • The intended use of the building moves most customers off-site (Apostle Islands trips) To summarize, the recently renovated structure improves upon safety and aesthetics, while benefiting local business and adding to the tax base. When we applied for a building renovation the existing building had been a motel. At that time we worked with C&S engineering to provide a building plan, and this plan went through the proper channels and was ultimately approved by the State. Whether the department was made aware I'm not sure. This is a commercial property, and at that time, at least from what I can remember, I didn't need local approval. The structure is one building with multiple uses. Retail store and office, classroom, certified kitchen, boat storage, and 2 lodging units, one is a more standard motel-like room downstairs that is ADA accessible and one unit upstairs that was modeled to be a 'bunkhouse' (at first a rent by the bed facility, until Covid happened) Now we rent the upstairs space as a unit to families, etc. Maybe I missed it, but I do not see the 2-unit lodging in the downstairs. Be aware that when you change uses of an existing structure, a zoning permit may be required. In this case, adding three or more units triggers a conditional use permit for a multiple unit development. 6) If this existing structure is deemed to be a Multiple Unit Development, Bayfield County Ordinance Sections 13-1-29 and 13-1-42 would apply. Section 13-1-29 requires open space be provided or a waiver request be submitted. Section 13-1-42 requires an Environmental Impact Analysis (EIA) or waiver request be submitted. I'm not sure who determines if it is a MUD or not. We'll go in he direction that makes the most sense. If you have more than a hotel/motel use in the building and three or more units, the department would recommend seeking a conditional use permit for a multiple unit development. The MUD would include a 3-unit motel/hotel and 1-unit store. The property is located in the shoreland district and the unincorporated village overlay district. The existing building is serviced by public sewer. The project is located on a 0.32-acre parcel identified as Tax ID# 37525 and described as Lot 1, CSM 1983 in V.ll P.353-354 Doc# 2016R-566052, Section 34, Township 51 North, Range 6 West, Town of Bell, Bayfield County, WI, hereinafter referred to as the subject property. The need to obtain a conditional use permit was triggered when the County Board approved the new short-term rental ordinance July of 2024. This required all existing operators with Public Health licenses to obtain a zoning permit if they did not have one. The Bayfield County Public Health Department has a license for the existing structure but there is no zoning permit for it to operate either as a short-term rental or a hotel/motel. Historically, the existing building had been used as a hotel/motel and was considered a nonconforming use until the hotel/motel use ceased for more than 12 consecutive months based on Bayfield County Public Health Department records. As such, the property owner was required to bring the property into compliance with current ordinance. Currently, the property owner is operating a 1-unit store and 3-unit hotel/motel on the subject property. This requires a conditional use permit for a MUD because it includes 3 or more units. The proposed uses of the MUD are allowed in the C zoning district. Bayfield County Zoning Ordinance Section 13-1-29 applies and environmental impact analysis (EIA) are required, see code below. (a) Introduction. A Multiple Unit Development is a development on a single lot consisting of three or more units. It may be a condominium (in which case the tot consists of the condominium property); or a lot improved with a multiple unit dwelling; or a tot improved with a hotel/motel; or a lot improved with three or more units of other types. It requires a conditional use permit under Sec. 13-1-41 and an environmental impact analysis under Sec. 13-1-42, and shall also meet the following requirements: (®®4/9/2oo?) Additionally, each MUD requires a certain amount of open space. The proposed project will be unable to meet the required open space requirements. Per Bay field County Zoning Ordinance Section 13-l-29(b)(3), see code below, each unit would require 30,000 square feet of open space.
