Hi Ruth,
I recently completed an onsite consultation for a couple moving to the area and hoping to learn about the
development process. I alerted them to the fact that they have an unpermitted shipping container on the property
that needs to be permitted per the rules of the moratorium. Can the ATF fees for this permit be waived, given they
voluntarily reached out to the Department to ensure they were building in compliance with all zoning standards.

Thanks so much for providing the land assessment report. This brings us an important step forward to
ensuring that our house plans will work for the site; to that end, I've provided the report to Bill Erickson,
who is currently working on the plans. In particular, that's GREAT news about the potential ability to hook
up to municipal sewer. Who should we contact to make that determination? Looking around the
county website, I'm realizing I'm not sure where to go.
Again, we are so very sorry about our failure to properly permit the container. It's clear now that we
should've inquired. Can you point us to the right application to use for a temporary zoning permit?
Backstory on the container: Since we've been camping up there each summer, we wanted to store
camping supplies, mowers, etc. we use to avoid lugging everything back and forth to Denver and
southern MN (where I have family). After zero success securing a storage unit nearby (plus months on
waiting lists), we figured a container was the simplest solution. Since it wasn't a "permanent" structure, it
didn't dawn on us that it may not be allowed. So that's not an excuse, but rather an explanation, and we
now regret our lack of foresight.
The report refers to a "moratorium on the placement of shipping containers in the county" requiring
landowners to obtain permits to temporarily place a shipping container for a "period of no more than 12
months." It also refers to a potential "conclusion of the moratorium." So, a few container-related
questions to help us plan:
• As of now, after we submit our application by April 8, would that secure us 12 months from April
20247 Or would the permit be backdated, given the container was placed previously?
• What happens when the 12-month period elapses? Will it be possible to apply for another
temporary permit?
• Have there been any external communications about if/when this moratorium may conclude?
As we've mentioned, we plan to move to Bayfield - and begin construction on our house! -- in June 2025.
We're eager to ensure we do everything by the books, so we appreciate whatever insight you may have to
help us make sure the container doesn't create any issues.

Happy to report that we have filled out the land use application and it is ready to submit. One question
before I email the application to permitsfcpbayfieldcounty.wi.gov (CCing you) and drop the hard-
copy application and check in the mail: Is the correct fee for the category of "land use
administrative review" and "non-habitable residential... accessory structure," meaning 320 SF
x $0.20/SF = $64, but we increase to the $75 minimum? Meaning $75 is due at this time?

Yes, the container is already placed on the property - and no, we weren't aware that a permit
was required prior to placement. I will forward a separate email chain with Alessandro (sent
from my business email, heather@myredj:)enLc[Lc_Qm) for your reference. Long story short we
proactively enlisted Alessandro to do a land assessment report in early 2024; that's when he
noted the container and we realized our error. Alessandro appreciated our situation/candor
and requested that his director (you?) waive the after-the-fact fees for your permit, which was
indeed waived. We greatly appreciated the understanding. We're trying to get everything right,
but the permitting and building process is 100% newto us.
2. Is the shipping container anticipated to remain after construction of the house is complete?
Yes, we have been anticipating keeping the shipping container on the property for
supplemental storage purposes.
3. Are there currently any other structures on the property?
No, there are no other current structures on the property. There is an old well head in the
center of the property (not sure if that counts).
4. Need letter of authorization signed by Heather Reagan since she did not sign the application and also
has joint ownership in the property. An electronic copy of the attached completed form is sufficient.
Happy to provide. To be clear, do you mean that I should print a copy of the completed
form, add my signature, and scan/return to you?
5. A land use permit application, see attached will need to be submitted and approved. If approved, the
conditional use permit allows the use and the land use permit allows the structure's placement
associated with this use. The land use permit application does not need to be submitted prior to the
conditional application moving forward but it will need to be approved before the placement of the
shipping container is officially approved.
The comments above need to be addressed no later then 9 AM on Thursday, April 17th for this item to be placed
on the May 15th Planning and Zoning Committee meeting agenda.
We will get the land use permit submitted by Thursday, April 17, as requested. (John flies back
Tuesday night.)

Request Summary:
John McRee and Heather Reagan, owners, request a conditional use permit to keep a shipping
container already placed on their property identified as Tax ID 4893, hereinafter referred to as the
subject property. The subject property is comprised of approximately 7.6 acres.
The subject property is zoned Residential-Recreational Business (R-RB). A conditional use permit
is required to place any shipping container on an R-RB lot. The project is also in the shoreland
district as there is a small pond Northwest of the site, within 1000 feet of where the shipping
container is placed.
The request is after-the-fact given that the owners placed the container without obtaining a permit
first. However, the department waived the after-the-fact fee given that the owners indicated they
were unaware a permit was required, and they were timely in filing an application after they
discovered a permit was required. They indicated they plan to build a house on the property and are
only using the shipping container for storage. The department issued a temporary permit for the
shipping container on May 9, 2024, given the county was under a moratorium for shipping
container placement. We received a land use permit application for a dwelling on May 1, 2025.
The subject property has a driveway off Weber Rd., which is a town road. It is a heavily wooded
lot. The existing vegetation on the subject property helps provide a natural screen from the adjacent
neighbors. However, the shipping container is currently viewable from the town road. It could be
relocated to not be visible from the road.
To date, no correspondence has been received related to the request.
If the Committee approves the conditional use permit, the department recommends the following
conditions be added:
1) The shipping container be relocated so that it is not visible from the public right-of-way.
2) An opaque vegetative screen be maintained to completely screen the shipping containers
from the public right-of-way and the adjacent properties.

To Whom It May Concern:
As you know, the Bayfield County Planning and Zoning Committee conducted a public hearing /
meeting on May 15, 2025, where you, Heather Reagan and John McRee, informed the
Committee of your application for the above mentioned. After discussion and review, the
Planning and Zoning Committee approved your request with conditions based upon town
board recommendation.
The approval includes the following:

o Granted: shipping container in parcel tax ID 4893
with the following conditions:
1. Shipping container must be relocated (after construction of home) so that it is not visible from
the public right-of-way;

container from the public right-of-way and the adjacent properties
Congratulations on obtaining this approval. Be advised any aggrieved party has the right to
appeal this decision to the Board of Adjustment within thirty (30) days.
Enclosed is a copy of the affidavit prepared by this Dept. setting forth the terms and conditions
of your permit. Your $30 check and the original affidavit will be taken to the Reg. of Deeds Office
for recording. After recordation, your permit card will be mailed to you provided all requirements
have been met and/or submitted.

Please note, receiving approval from the Planning and Zoning Committee at the meeting, does
not authorize the beginning of construction or land use, you must first obtain individual
land use application(s) / permit(s) from the Planning and Zoning Department. Terms and
conditions of your permit shall be binding upon, and inure to the benefit of, all current and future
owners of such property.
Also, this permit entitles you to the work specifically described in the application and plans, and
as limited by any conditions of this permit. No changes in the project or plans may be made
without prior aeproval of the Bayfield County Zoninci Committee. The issuance of this
permit does not relieve you of your responsibility to obtain a permit or approval required by your
township, State of Wl, or federal authority (i.e., US Army Corps of Engineers).
Be advised your Conditional Use permit shall automatically terminate 24 months from its date of
issuance if the authorized building activity, land alteration or use has not begun within such time.
If your Conditional Use is discontinued for 36 consecutive months, the permit authorizing it shall
automatically terminate, and any future use of the building(s) or property to which the permit
pertained shall conform to Ordinance.
Any person aggrieved by a decision of the Planning and Zoning Director and/or Planning and
Zoning Committee, may request a public hearing before the Board of Adjustment. The appeal
notice shall be filed with the Planning and Zoning Director within thirty (30) days after written
notice of the order or decision appealed from was sent by first class mail to the aggrieved party.

The purpose of this affidavit is to make the foregoing a matter of public record in the office of the Bayfield County Register
of Deeds, per Bayfield County Planning & Zoning Ordinance, Title 13, Chapter 1, Article C, Section 13-1-41:
"If a conditional use permit is approved with conditions, an appropriate record shall be made of the land use and structures
permitted, and prior to the issuance of the permit the Zoning Department shall record with the Bayfield County Register of
Deeds an affidavit prepared by the Zoning Department setting forth the terms and conditions of the permit and a legal
description of the property to which they pertain. The recording fee shall be paid by the applicant. The terms and conditions
of the permit shall be binding upon and inure to the benefit of all current and future owners of the property to which it pertains
un/ess otherwise expressly provided by the permit, or unless the permit terminates under subsection (d) of this section."
Also, this permit entitles you to the work specifically described in the application and plans, and as limited by any conditions
of this permit. No changes in the project or plans may be made without prior approval of the Bayfield County Zoning
