Sanitary Permit issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one - and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the UDC. I'm approving your application and our clerk, Dylan, will reach out to you for additional payment. The original fee was $325 ($150 + $0.005 x $35,000). As I mentioned, since the project was started without a permit, there will be an After the Fee, which is triple, and $75 for the return inspection. $325 x 3 = $975 + $75 = $1050. Since that container is in a different location and since there is now more than one container on the property, to bring the property into compliance you will either need a Conditional Use Permit for the containers or to remove the containers. Our department requires a Land Use Permit for any container to be placed on a property for any length of time, and a Conditional Use Permit for more than one container to be placed for any length of time. If you want to be able to move the containers around on your property, then in the Conditional Use Permit application, you can designate an area you would move them within. That way, our department can make sure that area meets the required setbacks, and then you can move the containers within that area without requiring a new Land Use Permit. Putting the containers on a trailer would still require the appropriate permits, because they would still fall under the definition of a Shipping Container/Intermodal Container: (57m) Shipping Container/intermodal Container. A shipping container / intermodal container, is a large, standardized shipping container, designed and built for intermodal freight transport. intermodal containers are primarily used to store and transport materials and products efficiently and securely in the global containerized intermodal freight transport system. Here are the sections of our ordinance that apply: (57m) Shipping Container/Intermodal Container. A shipping container / intermodal container, is a large, standardized shipping container, designed and built for intermodal freight transport. Intermodal containers are primarily used to store and transport materials and products efficiently and securely in the global containerized intermodal freight transport system. (Ca/3of2o21). (A)5128/2024) Title 13, Chapter 1, Article B Zoning Code (9) Agricultural and Forestry Zoning Districts. Shipping containers are allowed in agricultural and forestry zoning districts, A-1 and F-1, if the lot is 4.5 acres or greater and A-2 and F-2, if the lot is 35 acres or greater. A land use permit is required to permanently place a shipping container on a lot. More than one (1) shipping container on a lot requires a Conditional Use Permit (CUP). (C?bi2&2o24) If you can provide evidence that all shipping containers were placed in their current locations prior to 3/30/2021, then they would be deemed nonconforming. Otherwise, they would be considered illegally placed and need to be removed or a Conditional Use Permit will need to be acquired. The department has been unable to find aerial photography evidence to support placement of shipping containers in their current locations prior to 3/30/2021. If you chose to remove the containers, please let me know when they are removed so I can come out to the site to confirm. If you wish to apply for CUP, the application needs to be received by our department by November 7, 2025, to be placed on the agenda of the December Planning and Zoning Committee meeting, The timeline to approve your current application depends on which option you choose. Based on 2022 aerial photography, they don't appear to be in their current location: I'm not familiar enough with the other structures on the property to tell from the aerial photo if the containers/connex boxes might be in another part of the property. Dirt work is allowed before getting a permit (for properties not in the Shoreland/wetland/flood plain). However, when I was on site it seemed like significantly more than dirt work had been done. It looked like work on the floor was done and in floor heating was being installed: You can continue to do dirt work, but do not do any more work on the floor (or other parts of the structure).
