Sanitary Permit issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one - and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the UDC. Now we can concentrate on the "Nutshell" and residential permit request you have. When I sent in the land use application it was to replace that non conforming structure with the same size and location. Use would remain the same and it would have a bedroom and bathroom with no kitchen facilities. I knew the existing sewer systim was outdated therefore we connected it to the new proposed sanitary permit so there were no issues. Based on that I didn't thinkwe needed to do a conversion because the use had not changed and the structure by code could be rebuilt. When the sanitary permit is issued please issue the land use for the "Nutshell" Moving onto the residential addition which you have a land use application received I believe it can be issued all in one permit because the covered walkway is a UDC compliant structure connecting the structures. We supplied you with a complete site proposal so there were no surprises and you had a complete depiction of our intentions. This has been on the drawing board for ten years and the plan is all or nothing. I have been involved for the past three years and this proposal meets all of the County requirements Page 2 of my land use application asks for OHWM that elevation is 1395.79 Elevation of Floodplain wasn't filled in but it is 1398. All shoreland setbacks are a minimum of 75" The four season porch addition has a full basement under it to the size of 382 sq. ft all the rest is frost walls and footings. The pool is concept at this time so lets ignore that and the lower stone wall will not happen. Let's go with this bite for now and continue on. Thanks. If the structure is indeed a cabin with bedroom and kitchen, there are two options. As of now there are three habitable structures on this property (including the 'nutshell'). The house furthest to the west can be disregarded since it can legally exist on its own parcel if divided. However, to permit the 'nutshell' there are two options as per our nonconforming shoreland ordinance. It can be rebuilt as a bunkhouse, which would require removing the kitchen sink and cooking area OR you can seek a conditional use permit to rebuild as a fully habitable cabin with kitchen. It is a tiny cabin that has always included a living room/loft, fireplace, kitchen, full bathroom with toilet, sink and shower. It has its own septic field and well too. The survey also shows that the lakebed extended further into a small bay that included a dock. Aerial images verify this as being there through 2010. Was this fitted? If so, was there any DNR permitting? This would also require permits through the county because it is in the floodplain. In 2011-13 we went through an extensive process of working with consultants, lawyers, local, county, state and federal agencies to get permission to refill the lagoon area back to its original state. This was part of the overall Birch Bend land restoration and management plan. We engaged Chequamegon Bay Engineering, Inc. (William G. Kurtz P.E) to manage the process working with i with local, county zoning, state and federal agencies. We are in the process of possibly revoking the permit for a similar situation on Birch Point Road. The UDC does not consider their breezeway to be sufficiently connected to the other structure and would have to be considered two independent residences which is not permitted on that property. As to the nutshell cabin, I think I gave you the options in another email. I can copy that here. The last sentence gives you the options on how we can proceed with permitting that structure. Further, improvement that is in excess of fifty -percent of the assessed value of the structure is prohibited. Have there been any assessments that can establish value and/or the original use? Exceptions to this prohibition can be allowed if all Nonconforming Structures ordinances are met. See below. (e) Shoreland Nonconforming Uses. We went through 4000+ photos to find these photos of the Nutshell. We also found the original brochure which there are pictures included in this file. The brochure shows that the Nutshell had a full bathroom and kitchen that required a septic system. We went through 20+ years of online financial records and found what we could of maintenance expenses directly related to the Nutshell. There was more but the work done on the Nutshell, but the work was combined with work done with other buildings on the property (painting, electrical, plumbing, appliance maintenance) and paid as one invoice for all of the work done on the multiple buildings. We don't have septic records because we never had any issues and never received any testing notices from the county like our two other septic systems. We would appreciate that prompt action is taken next week on issuing this permit as we are going to be doing be doing work with Butterfield on the main house and want to combine it with the Nutshell to maximize our project efficiency which will lead to more taxes for Bayfield County. Here are photo's of the current Nutshell inside. As you can see they are time stamped 11120125. These were taken a few day's ago as we wanted to know what items were sold on the estate sale we had supporting 3 local charities. The range we purchased awhile back was sold and shows the empty space. The bed/sofa cushions, and floor rug were also sold. As to maintenance, we did replace that deck as well as others in 2003 when Jerry Olson was remodeling the log cabin. We also put a new pump in through Rasmussen but I did not save that invoice. We reupholstered cushions, drapes, curtains, shower curtain with dates shown on computer list. There were no separate electrical bills as that was all included with the main house. We have not had any issues with the septic system so have no maintenance records. We have never been notified by the county for inspection. I hope this answers some of your questions. We went through 4000+ photos to find these photos of the Nutshell. We also found the original brochure which there are pictures included in this file. The brochure shows that the Nutshell had a full bathroom and kitchen that required a septic system. We went through 20+ years of online financial records and found what we could of maintenance expenses directly related to the Nutshell. There was more but the work done on the Nutshell, but the work was combined with work done with other buildings on the property (painting, electrical, plumbing, appliance maintenance) and paid as one invoice for all of the work done on the multiple buildings. We don't have septic records because we never had any issues and never received any testing notices from the county like our two other septic systems. We would appreciate that prompt action is taken next week on issuing this permit as we are going to be doing be doing work with Butterfield on the main house and want to combine it with the Nutshell to maximize our project efficiency which will lead to more taxes for Bayfield County. 14 If you have any questions, please call me at 612.860.4123.
