The Bayfield County Planning and Zoning Committee of the County Board of Supervisors

Request Summary:
Timothy & Connie DeChant, owners, and Jeff Zeilenga, agent, are applying for a conditional use
permit to construct a commercial garage in a Residential -Recreational Business. The use is
proposed to be located on 0.53 acres of leased area within a 5.47 -acre parcel identified as Tax ID
35429, hereinafter referred to as the subject property.
The leased area encompasses a 70 -foot or less strip along the Northern end of the subject
property. The applicant is intending to construct a commercial garage to store grooming and
other equipment for trail maintenance. The garage is anticipated to be 10 feet from the North
property line and 63 feet from the centerline of Drummond Lake Rd.
The proposed use is in the Shorelands since it is within 1000 feet of Mill Pond Lake. There is
mapped floodplain along the Western edge of the subject property but no mapped wetlands.
There is an existing house, garage, and two sheds in the Southwest corner of the property. The
proposed commercial garage will be over 100 feet from the existing residential use on the subject
property.
The town recommended approval for the request. No other correspondence has been received to
date.
Alternatives:
When deciding whether to recommend approval of the proposed conditional use permit the
Committee should consider Bayfield County Ordinance Section 13-1-41(c).
The Committee may approve, approve with conditions, or deny the request. Substantial evidence
should be provided to support the decision. Wisconsin Act 67 defines substantial evidence as
"facts and information, other than merely personal preferences or speculation, directly pertaining
to the requirements and conditions an applicant must meet to obtain a conditional use permit and
that reasonable persons would accept in support of a conclusion". It is also important to note that
any conditions imposed "must be related to the purpose of the ordinance and be based on
substantial evidence" and "must be reasonable and to the extent practicable, measurable" as
outlined in the UW-Extension memo titled "Conditional Use Permits After 2017 Wisconsin Act
67" authored by Brian Ohm.
Department Recommendation:
The department recommends that the Committee approve the request with the following
conditions:
1) For storage of trail maintenance equipment only. If commercial use changes, a new
permit will be needed.
2) All equipment needs to be stored inside the garage.

We are sending you this letter to advise you of the upcoming Bayfield County Planning and Zoning
Committee Public Hearing and Meeting. This notice is also being sent to landowners within 300
feet of the proposed use; the town clerk of the town in which the property is located; and the town
clerk of any other towns within 300 feet of the proposed use.
This written notice is regarding a Conditional Use Application submitted by Timothy & Connie
DeChant, owner and Jeff Zeilenga, agent (Drummond) — [Conditional Use: Garages
(Commercial)] — Equipment storage building in a Residential -Recreational Business (R-RB)
zoning district on Tax ID 35429.
Copies of all information regarding this request are available by email request at
zoningCa-bavfieldcounty.wi.gov or in person at the Bayfield County Courthouse, 117 E 5th St.,
Washburn, Wisconsin.
This matter will be addressed by the Bayfield County Planning and Zoning Committee at their
meeting on Thursday, November 20, 2025 at 4:00 pm in the County Board Room of the Bayfield
County Courthouse, Washburn, Wisconsin.
Be advised; the Town of Drummond will consider this application prior to the Planning and Zoning
Committee meeting. Please contact the Town Clerk to verify the date and time of their meeting
and the date and time of the Town Plan Commission Meeting.
If you wish to comment on this matter, you are invited to attend the Planning and Zoning
Committee meeting or write to the Bayfield County Planning and Zoning Department. Written
and digital input pertaining to any agenda items will be accepted until noon the day prior to the
Planning and Zoning Committee Meeting (Bayfield County Ordinance Section 13-1-41(b)(1) and
13-1-41A(b)(2)). Subsequent input must be delivered in person at the meeting.

As you know, the Bayfield County Planning and Zoning Committee conducted a public hearing I
meeting on November 20, 2025, where the Committee reviewed your application for the above
mentioned. After discussion and review, the Planning and Zoning Committee approved your
request with conditions based upon town board recommendation and it is good for the
community to find a place to store the groomer.
The approval includes the following:
> Classification List: Garages (Commercial)
o Granted: Conditional use permit to construct a garage for equipment storage in a
Residential -Recreational Business (R-RB) zoning district on 0.53 acres of tax ID 35429
with the following conditions:
➢ The garage be used for storage of trail equipment;
➢ All lighting must be in line with Dark Sky best practices with downward -facing lighting;
➢ If there is any change in use other than storing equipment, a new permit is required.
Congratulations on obtaining this approval. Be advised, any aggrieved party has the right to
appeal this decision to the Board of Adjustment within thirty (30) days.
Enclosed is a copy of the affidavit prepared by this department setting forth the terms and
conditions of your permit. Your $30 check and the original affidavit will be taken to the Register
of Deeds Office for recording. After recordation, your permit card will be mailed to you provided
all requirements have been met and/or submitted.

Any person aggrieved by a decision of the Planning and Zoning Director and/or Planning and
Zoning Committee may request a public hearing before the Board of Adjustment. The appeal
notice shall be filed with the Planning and Zoning Director within thirty (30) days after written
notice of the order or decision appealed from was sent by first class mail to the aggrieved party.

The purpose of this affidavit is to make the foregoing a matter of public record in the office of the Bayfield County Register
of Deeds, per Bayfield County Planning & Zoning Ordinance, Title 13, Chapter 1, Article C, Section 13-1-41:
"If a conditional use permit is approved with conditions, an appropriate record shall be made of the land use and structures
permitted, and prior to the issuance of the permit the Zoning Department shall record with the Bayfield County Register of
Deeds an affidavit prepared by the Zoning Department setting forth the terms and conditions of the permit and a legal
description of the property to which they pertain. The recording fee shall be paid by the applicant. The terms and conditions
of the permit shall be binding upon and inure to the benefit of all current and future owners of the property to which it pertains
unless otherwise expressly provided by the permit, or unless the permit terminates under subsection (d) of this section."
Also, this permit entitles you to the work specifically described in the application and plans, and as limited by any conditions
