LINDSEY May 19, 2025 Ruth Hulstrom Bayfield County Zoning Department 117E5`hSt Washburn, WI 54891 RE: Ross Darst Permit Application — Shipping Container Storage Facility Tax ID: 37856 Dear Zoning Administrator Hulstrom: This letter is submitted on behalf of my client, Ross Darst, along with permit applications for a shipping container storage facility located on his property in Iron River, Tax ID 37856. Mr. Darst has operated a mini -storage business on this parcel for several years and has obtained zoning permits for the three existing storage buildings (Permits 19-0262, 21-0098, and 22-0085). In connection with his mini -storage business, Mr. Darst has been adding shipping containers to his property for additional storage space for rent. Several of these storage containers were on the property in 2022 when the Zoning Department did the on -site inspection for his 2022 permit, so he was previously unaware that additional permitting was required for these storage containers. Currently, Mr. Darst has 22 shipping containers that he rents for storage, each being 8' x 20'. The location of the storage containers are outlined in blue on the attached site plan. The containers are placed in two blocks of 8 containers and one block of 6, with each block consisting of the containers placed directly side -by -side. According to this placement, we provided the measurements on the site plan for the grouped blocks of containers, rather than measurements for each, individual container unit. My understanding on the correct procedure for Bayfield County Zoning approval of this operation is that Mr. Darst must first obtain a conditional use permit for the general operation of a shipping container storage facility, and then each separate container requires a land use permit for an accessory use. Accordingly, I am submitting the conditional use permit application as well as a separate land use application for the containers. I have included all 22 container units in the single land use application rather than filling out a separate application for each. However, we understand that a separate land use application fee would be payable for each unit and also that these are subject to after the fact permitting fees given that they have already been placed on the property. The subject property is comprised of approximately 6.9 acres. A conditional use permit is required to establish a Shipping Container/Intermodal Container Storage Facility in a C zoning district. The project is not in the shoreland or floodplain districts. There are mapped wetlands on the property but the area where the use will occur is 25 feet (minimum wetland setback) or more from the mapped wetlands. The subject property is developed with three existing storage buildings and a driveway and parking area. The owner indicated that they unknowingly placed 20 shipping containers on the subject property without a conditional use permit. They are requesting a conditional use permit to keep the 20 shipping containers placed. The shipping containers are placed in clusters. A 4 -unit cluster is located east of the most westerly storage building, and two 8 -unit clusters are located east of the most easterly storage buildings. The 8 -unit clusters are as close as 15 feet to adjacent property lines. The owner is requesting that the requirement to obtain a land use permit for placement of each shipping container be waived and instead a land use permit for each cluster be obtained. There is no lighting currently utilized on the subject property and no lighting is proposed with this request. Clients can access the site 24/7 but the owner indicated that most activity occurs during daytime hours. There is no gate limiting access to the site, but the owner indicated that law enforcement does patrol the area. Properties to the North are zoned Residential -I (R-1) or Industrial (I) and properties to the South, East, and West are zoned R-1. There is an assisted living facility owned by Willow Manor Inc. located North of the subject property. Property to the South near the proposed use is undeveloped. The shipping containers are not currently viewable from the public right-of-way when driving Northbound on District St. as there is dense vegetation located on the undeveloped property to the South. The shipping containers are viewable from the public right-of-way if traveling Southbound on District St. They are also viewable from the assisted living facility.
