Dear Sue: On Friday, March 31M, 2006 the Bayfield County Planning and Zoning Department received an anonymous complaint in regards to grading activity and operation of equipment in the shoreland buffer zone and on the lakebed of Lake Superior on the above referenced property. Our Department then contacted the Department of Natural Resources and subsequently John Spangberg halted further operation of equipment and grading activity on the said property and lakebed of Lake Superior. On Monday, April 03, 2006 John Spangberg (WI DNR), Diane Daulton (ABDI Land Conservation), Karl Kastrosky and myself (Bayfield County Planning & Zoning) met with you on -site to further investigate the alleged violations. The Bayfield County Planning and Zoning Department's jurisdiction starts at the Ordinary High Water Mark (OHWM) of Lake Superior and continues landward. According to Section 13-1-24(b) of the Bayfield County Zoning Ordinance a Class A Special Use permit shall be required for excavating, grading or filling of two hundred (200) square feet or more within one thousand (1,000) feet of the normal high water mark of Lake Superior. Further, according to Section 13-1-23(a)(1) of the Zoning Ordinance the removal of trees, shrubs, and ground cover, and land disturbing activities are prohibited in the Shoreland Vegetation Protection Area, an area of natural vegetation types paralleling the shoreline of a water body, stream or wetland. The Department determined approximately an area of 50 feet by 65 feet (3,250 square feet) was disturbed with spoils and grading in the Shoreland Vegetation Protection Area on the above referenced property. The Department requires you to apply for an After -the Fact (ATF) Class A Shoreland Grading permit, due to ATF charges the application fee is $350.00 (application enclosed). The application needs to be completed and returned to our office by April 19, 2006. In addition a citation of $249.00 is issued for land disturbing activities in the Shoreland Vegetation Protection Area. If you wish to contest or not pay this citation, you must appear in Court at 1:30 p.m. on May 8th 2006. If you fail to comply with this order the County will file a summons and complaint with the Bayfield County Clerk of Court seeking compliance with the Bayfield County Zoning Ordinance. The daily forfeiture for non- compliance may be up to $500 a day. After the spoils are removed from the site and properly disposed of per Department of Natural Resources requirements, Best Management Practices (BMPs) need to be followed for erosion control and stabilization of the disturbed area. Part of our shoreline restoration plan is to remove the sawdust washed up on the far east beach on the motel property. I mistakenly authorized my construction crew to remove the sawdust without ,realizing I needed a permit from the DNR. I also did not realizc that the sawdust should have been staged on the black top rather than the ground. As soon as the error was reported I met with John Spangberg (DNR), Diane Daulton (ABDI Land Conservation), Karl Kastrosky and Travis Tulowitzky of Bayfield Co Planning and Zoning Department. At that meeting I took full responsibility for going ahead without the proper application. I explained that my mistake came out of ignorance and not from any desire to intentionally "get away with anything". Everyone at the meeting was very helpful by teaching me what I needed to do both to comply now and to keep the lines of communication open for the future.
