Below are the requested responses: LOMA Documentation Attached is a clearer copy of the FEMA Letter of Map Amendment confirming removal from the floodplain. Parking A total of 10 parking stalls will be provided onsite for the bar use. Hours of Operation Our intended hours are: • Wednesday —Sunday: Open at 11:00 AM • Closing time is dependent on business; allowable bar close times are: 2:00 AM Sunday —Thursday 2:30 AM Friday —Saturday We may consider opening Mondays/Tuesdays seasonally during peak summer and winter months. Exterior Lighting Three down -facing 2" recessed can lights are installed in the soffit above the entry area. A standard neon OPEN sign is also located on the exterior wall. Exterior Storage No exterior storage associated with the building. The property does contain an existing 40x80 pole barn, which remains unchanged. Current ordinance requires a conditional use permit to operate a bar in an R-RB zoning district. No conditional use permit is on file to allow for a bar to operate on the subject property. In June of this year, the property owner contacted the department before starting renovations. Unfortunately, a miscommunication occurred and department staff indicated no permits were needed to renovate the existing building given the property owner indicated they were not changing the building envelope and the bar use was existing. The department staff who provided this guidance was unaware that the bar use had ceased for 12 consecutive months. A sanitary permit application was received November II, 2025, and a different department staff familiar with the area noted concern about the lack of permitting for the use and renovations that were underway. Bayfield County Ordinance Section 13-1-40(c)(4), see below, requires a nonconforming use that ceases for 12 consecutive months be brought up to current ordinance. "Discontinuance. If a nonconforming use is discontinued for twelve (12) consecutive months, any future use of the building, structure or property shall conform to this Chapter." The property owner wishes to renovate within the existing building envelope and operate as a bar. As such, they will need a conditional use permit to renovate and operate. Aside from the building that was previously operated as a bar, there is a shed, pole building, and three residences on the subject property. None of these existing buildings are proposed to be associated with bar use. There are permits on file for the pole building and one of the three residences. The three residences have a zoning permit to operate as short-term rentals. The existence of the three residences makes the site a 4 -unit multiple unit development. This is a nonconforming use since there is no conditional use permit on file for a multiple unit development and it existed prior to the town adopting zoning. If renovations are needed to any of the residences in the future, the property owner should be aware that Bayfield County Ordinance Section 13-1-40(c)(2) could be triggered, which states the following: "Prohibited Expansion. The alteration of, or addition to, or repair in excess of fifty percent (50%) of the assessed value of any non-shoreland existing building, premises, structure or fixture for the purpose of carrying on a nonconforming use is prohibited." If the above section is triggered, then they would need to obtain a conditional use permit for a 4 - unit multiple unit development and meet the requirements of Bayfield County Ordinance Section 13-1-29 before proceeding with renovations. In 2007, variances were granted to allow lesser shoreline frontage than what was required for a multiple unit development and a lesser setback to the Ordinary High -Water Mark to Lake Namekagon to replace one of the three residences. There were conditions associated with the variances approved that the department is reviewing with Corporation Counsel and the DNR Shoreland Specialist to see if the variances and related conditions still apply to the subject property. The proposed use includes 10 on -site parking stalls, located South of the bar building. No outdoor storage is proposed, and lighting will be downward facing aside from a neon OPEN sign located on the exterior of the building. Proposed hours of operation are Wednesday -Sunday, opening at II AM with closing at either 2:00 or 2:30 AM. They are considering being open Mondays and Tuesdays during busy summer and winter peak months. There is an existing driveway off County Hwy. D, South of the proposed bar building that provides ingress and egress. Surrounding properties are all zoned R-RB. There is no development on adjacent lots to the North and East. Future development on these lots may be limited given the mapped wetlands and floodplain located in this area. There is an existing residence on the property to the South. The subject property abuts Namekagon Lake to the West. A letter of map amendment removing the bar building and other buildings on the subject property from the mapped floodplain is on file. There are mapped wetlands along the Eastern and Southern edges of the subject property. The entire property is in the shoreland district since it is 300 feet from Namekagon Lake. There are also two small ponds located on the subject property, see below image with ponds identified with a red pin. A parking lot is considered a structure in the shoreland district. A land use permit will need to be obtained to develop the parking area and confirm it meets shoreland regulations. Concurrently, the department will review it to make sure the land use permit meets wetland and floodplain requirements. A better site plan will be needed identifying the parking area and identifying setbacks to wetlands, Ordinary High -Water Marks of navigable waters, and mapped floodplain. The town board recommended approval with the condition there be no parking between the building and County Hwy. D. No other correspondence has been received. Department Recommendation: If a code compliant location for the parking area can be approved, the department recommends that the Committee approve the conditional use permit request. This is based upon the town approval recommendation, adjacent properties being zoned R-RB, economic impacts of the request, limited impacts on natural resources given the bar building is existing and no change to the building envelope is proposed, and lack of opposition from the public. The Committee should consider whether limiting hours of operation to midnight or earlier are appropriate given the existing residential development South of the subject property.
