Zoning Agency 48080 Atkins Lake Lane - Land Use Permit for Grading for Todd and Jill Gibbon 1.0 Introduction This project consists of grading approximately 5,100 square feet of land around the existing residence at 48080 Atkins Lake Lane to improve drainage away from the structure and stabilize existing slopes. All grading occurs within the existing tree line, and no tree removal is required. The grading area lies within 300 feet of the Ordinary High Water Mark (OHWM), with portions occurring within 75 feet and limited areas within 35 feet of the OHWM. Because the disturbed area exceeds 1,000 square feet within 300 feet of the OHWM, this project requires a Class A Special Use Permit under Sec13-1-24(d) of the Bayfield County Zoning Ordinance. The property address is 48080 Atkins Lake Lane Grand View, WI 54839. 2.0 Purpose The purpose of this grading project is to correct long-standing drainage issues around the cabin by reshaping the ground surface to direct stormwater away from the structure, reduce ponding, and stabilize the site. The work is limited to surface grading and does not include any new impervious surfaces, retaining walls, or shoreline alterations. 3.0 Existing Conditions • Total grading area: 5,100 sq ft • Estimated fill volume: 215 cubic yards • All work occurs within the existing tree line • No vegetation removal beyond minor groundcover disturbance • Portions of the grading area lie within 75 ft and 35 ft of the OHWM • The site contains mapped FEMA Zone A Floodplain, but grading is located outside the current regulatory boundary • No rock retaining walls, riprap, or prohibited structures are proposed in the shoreland buffer zone Land Use Permit Page 1 RECEIVED FEB 24 2026 Bayfield Co. • No new impervious surfaces are proposed as part of this grading permiPlanning and zoning Agency • Existing impervious surfaces total 7,007 sq ft, representing 1.3% of the parcel area within 300 ft of the OHWM (per attached impervious surface form). See photos in Appendix A. 4.0 Grading Description The grading work consists of reshaping the ground surface around the cabin to improve drainage patterns. The work includes: • Raising low areas adjacent to the cabin to match the finished floor elevation • Smoothing and blending slopes to direct runoff away from the structure • Minor cuts and fills to eliminate depressions and reduce erosion potential • Maintaining all work within the existing tree line to avoid vegetation removal • No disturbance to the shoreline, no excavation below the OHWM, and no changes to the lakeward slope All spoils will be redistributed on site and compacted to final grade. No material will be placed within the floodplain or within any wetland. This work meets the requirements of Sec. 13-1-24(d), which requires a Class A Special Use Permit for grading exceeding 1,000 sq ft within 300 ft of the OHWM. See site map in Appendix B. 5.0 Impervious Surface Compliance This grading project does not add any impervious surface. The parcel currently contains 7,007 sq ft of impervious area, representing 1.3% of the lot area within 300 ft of the OHWM. Under Sec. 13-1-32(c), impervious surface standards allow up to 15% without mitigation. This project maintains the existing impervious percentage and does not alter the impervious surface calculation. See Impervious Calculation Form in Appendix C. 6.0 Floodplain Considerations The patio project is near an existing FEMA Zone A floodplain boundary. No work or fill is proposed within the current regulator boundary. FEMA in conjunction with WDNR are in the process of remapping the entire Bayfield County Floodplain boundaries. Todd Gibbon, PE CFM has obtained the preliminary mapping elevation data for 48080 Atkins Lake Lane. The new Zone A floodplain will have a nonpublished Regional Flood Elevation of 1443.5. The proposed top of the concrete patio is 1444.5'. The finished first floor elevation of the cabin is 1444.9'. The proposed project is outside of the existing regulatory boundary and as a future proofing measure is above the preliminary mapping elevations. 7.0 Erosion Control Measures Erosion control measures will be implemented exactly as shown on the grading plan and consistent with Sec13-1-24(d)(4) and Sec 13-1-41(c). Measures include: • Temporary and permanent seed mix applied to all exposed soil • Final seeding within 7 days of achieving final grade Reseeding any areas not achieving 70% vegetative cover Land Use Permit Page 2 RCECEWED FEB 242026 Bayfield Co. planning and Zoning Agency • Temporary erosion controls (silt fence or wattles) installed downslope and maintained until permanent vegetation is established • Temporary seeding (oats before Sept 1, winter wheat after Sept 1) at 130 lbs/acre • Permanent seed mix: WisDOT Seed Mix #20 at 5 Ibs/1,000 sq ft • Nurse crop (oats or winter wheat) at 0.8 lbs/1,000 sq ft • Type A fertilizer at 7 lbs/1,000 sq ft • Straw mulch at 2,000 lbs/acre, crimped into soil • Stabilization of all stockpiles if inactive for more than 7 days • Removal of temporary controls only after vegetation reaches 70% coverage These measures ensure compliance with the County's requirements that the smallest amount of bare ground be exposed for the shortest feasible time and that disturbed areas be promptly stabilized. 8.0 Conclusion The proposed grading project improves drainage around the cabin, stabilizes the site, and does not increase impervious surface area. All work occurs within the existing tree line, avoids vegetation removal, and remains outside the regulatory floodplain boundary. Erosion control measures meet or exceed the requirements of Sec. 13-1-24(d) and Sec. 13-1-41. The project complies with Bayfield County's shoreland, floodplain, and grading standards and is appropriate for approval under a Class A Special Use Permit.
