Failure to obtain a permit or starting construction without a permit will result in penalties. The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one - and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the UDC. Our licensed master plumber is dropping off the required documents for the holding tank/septic requirements today as well. Based on requirements for our change of use permit presented to us by Bayfield County, we believe we have followed the guidelines set forth and request a Bayfield County representative come to our site, get the required documentation to approve this permit. Please advise when we can expect to see a representative. Further, -given the miss -communication from this fall related to this project, the permits, the initial e-mail stating we are good to proceed etc... which came from Bayfield County, we are optimistic our request for this change of use required on -site visit can be expediated. Township 48N Range 4W of Barksdale Township Dear Mr. & Mrs. Sherry, Pursuant to your request, the Bayfield County Planning and Zoning Department (department) is providing this correspondence in regard to the January 28" 2026 site evaluation and a follow-up file search for determining potential development on the above referenced property (hereafter referred to as the "subject property"). Specifically, what is the structural setback from the Town Road and Lake Superior due to the lake's estimated recession rate? In addition to evaluating the physical setting and the required setbacks as outlined in Sections 13-1-21, 13-1-22, 13-1-24, and 13-1-60 of the Bayfield County Zoning Ordinance (Ordinance), the following information was utilized in making the determination(s) contained herein: > The subject property is zoned R-1 > Structural setbacks from town roads shall be sixty-three (63) feet from the centerline of the street or road. > The required shoreline setback prior to shoreland regression calculations is 75 feet back from the top edge of the bank or bluff. > The subject property has a bank or bluff fronting to the lake, the top of which is discernible due to evidence of erosion, (including, but not limited to exposed rock), and therefore a greater safe setback shall be required as determined by the department, based likely shoreland recession rates based upon known past recession rates in the vicinity of the subject property (discussed hereafter). ➢ The calculations used to determine a safe structural setback is based upon three components that are combined to establish a safe setback: 1) stable slope, 2) recession setback of the bluff including an estimation of structure life, and 3) minimum structure setback. Based upon a review of the WDNR wetland inventory map, no areas as identified mapped wetland communities (greater than two acres) or point symbols (less than two acres) were noted within the subject property. After a walk-through of the subject property by the department it is apparent that wetland conditions (as evidenced by a preponderance of hydrophytic vegetation and observed hydrologic features) were not present. On parcels along Lake Superior where there exists a potential for erosion, the setback for future structures shall be increased beyond the minimum 75 -foot setback to a safe setback distance as measured from the top of the existing bluff. To determine this safe distance from the top of the bluff based on existing conditions, the department used the characteristics of the bluff with a slope angle of 33.6 degrees, bluff height of 20 feet and the recognized recession rate 0.2 per year. The combined components has a regression calculation of 100.8 foot setback from the toe of the slope. For reference the southwest corner of the dwelling is 102 feet from the nearest toe of the bluff. The building envelope to the southwest of the existing dwelling appears to be very close to the unknown but perceived location of the septic system serving the dwelling. Setbacks from the septic tank are 5 feet and 10 feet from the septic drainfield. In several septic searches no records were found within the documents that extend back to 1969. For the sake of this project the location of the system is all that needs to be known. It is recommended because of the apparent age of the system, size of the lot, and if potential increase in bedroom or vacation rental may be desired, the condition and design of the septic system should be verified by a master plumber and memorialized with the County. Applying the appropriate side yard (10 feet), shoreland setback distance (100.8 feet), center line of town road setback (63 feet), and considering the applicable Ordinance provisions, findings, and additional determinations stated herein, it is the department's position that a buildable area appears to be present in the subject property If the septic setbacks can be met. Since the subject property is located within a "shoreland area", or within 1000 feet of Lake Superior, any structure built within said area cannot exceed thirty-five (35) feet in height as pursuant to Section 13-1-22 (h). The height of a structure is measured as the difference in elevation between its highest point and its lowest point of intersection with ground level, exclusive of chimneys, communications equipment, antennas, weathervanes, and lightning rods which do not extend more than five (5) feet above the highest point on the roof. Please be advised, the fact that a "buildable area" presently exists does not expressly imply that this condition will exist for an indefinite time period. The information and conclusions presented herein are based upon current comprehensive Ordinance standards In place at the time of this correspondence. These standards may be subject to change in the future as the Ordinance Is considered a "living document" and subject to revision (through proper public notification) at any time. Thus, any changes to the Ordinance may improve or reduce the size of a "buildable area" within the subject property. t was noted that there is a deck that was built without permits upon the northeast side of the dwelling. This structure is approximately 10 feet from the top of the bluff. At this time the violation inhibits any other permit issuance for the property until the issue has been resolved. Options include, • Removal of the structure. • Appy for and obtain an After -the -Fact variance from the Board of Adjustment. This is an option but the likelihood of being granted is very low.
