All Land Use Permits expire Two (2) Years from the date of issuance if construction or use has not begun. Sanitary permit
issuance, if required, needs to occur prior to Land Use Permit issuance. Failure to obtain a permit or staring construction without a
permit will result in penalties.
The local Town, Village, City, State or Federal agencies may also require permits. The new construction of one- & two-family
dwellings requires review and approval by the local Uniform Dwelling Code (UDC) authority. Additions and alterations to one -
and two-family dwellings may require review and approval by the UDC authority. All municipalities are required to enforce the
UDC.
If subject property is part of a Condominium Plat, applicant hereby certifies and represents that applicant has all necessary
approvals and recorded documents required to complete the project for which this permit is sought including requirements set forth
in Wisconsin statutes pertaining to condominium associations, the Declaration of the Condominium Association in which the
property is located, and all other rules, regulations and requirements pertaining to that Condominium Association.

has told he to clear a 70' x 60' area for a pole barn that he plans to build. He also
Shoreland Grading (52,266 sq ft). Logan me plans
to do some other cutting of trees as needed in the buildable area. He has noted he was replant any areas where he clears vegetation

How about 10:30 am (Central Time) tomorrow? That gives me a bit of time to get organized
in my office before we talk.
Just to clarify:
A shoreline grading permit will allow you to cut down the trees outside of the 75' vegetative
buffer as long our other ordinances are met. However, before I can send you application to
the Town and move forward with the application, I need to understand what will happen
after you cut the trees, so I know if your plan fits within the ordinances.
For example, someone could get a Shoreline Grading Permit to cut down all the trees on
their property, if they explain how they will handle the spoils (will stumps be left or ground,
how they'll handle limbs/brush, how will erosion be prevented, etc), and that they will
replant the entire area with grass outside of the existing drive and the approximate area of
a proposed structure (which they mark on a map). Planting with grass (compared to a
range of trees and shrubs), might not be best practice, but it would meet our ordinances
If a property owner says that we want to cut down all the trees and cannot give me any
details on what they will do after, I can't move forward with the application until they
supply more details because I don't know if their plans will meet our ordinances.
The key part is that I can approve an application if know what will happen after the
trees are cut meets our ordinances.
In your case, it's not what the Shoreline Grading Permit will allow you to do, it's that you
need to provide more details before I can move forward with your application for the
Shoreline Grading Permit.
In summary, what I need to move your application along is for you to figure out your plans
for air you cut trees.

Hi Logan,
Before I forget, since the property is in a trust, you will need to fill out and send us an
Affidavit of Authority. You can email it to me or permits@thayfieldcounty.wi.gov.
In terms of the map, it shows the buildable area where structures can be placed. However,
the development in that area still needs to meet our other ordinances, including the
impervious surface stands I shared earlier and protecting the vegetating buffer. That's why
I need more details about what you are planning.
Here's what our ordinances say about the details required for a Shoreline Grading permit:

I've highlighted c, which is the main one I have questions about. Put in other words, if you
cut down all the trees in the entire buildable area, what will you do to restore the area
where you will not be building a structure or placing a driving/parking? That's what I need to
know. If you will just be selectively cutting or even cutting all the trees but leaving the
stumps in the ground, nothing may need to be done to restore it. However, if you clear all
the trees and grind stumps, then some kind re-planting/restoration will need to be done.
Also, if you plan to grind stumps up to the vegetative buffer (the 75' setback), you'll need to
share how you'll protect against erosion (i.e. adding silt fencing, creating a berm, etc.).
Keeping in mind any removal of stumps also affects the soil, so you likely cannot have any
kind of soil -based septic treatment (like an in -ground gravity fed system or a mound) in an
area where you've removed stumps.
I know it can be challenging to plan things out in advance, but that's what our ordinances
requires for shoreland lots.

It's impossible for me to determine where I want to put structures without removing trees. I
bought the lot based off a buildable sgft area which was provided by the county. I don't
plan on removing any' vegetation' at this time. Just trees so I can see what I bought.

As I mentioned earlier, property owners cannot go over 15% impervious
surface for the lot without a stormwater management or mitigation, so I need
to understand will happen to the area after you remove vegetation: which
parts wilt be developed (as a driveway, parking area, for the structure, etc.)
and which parts will be revegetated?
For example, selectively removing vegetation in the buildable area and fully
clearing an area for a structure and parking would likely meet our
ordinances. However, if someone was to remove all the vegetation in the
entire buildable area and add gravel to the entire buildable area, that would
not meet our ordinances.
Based on the information you have shared so far, I don't have a clear
understanding of the extent of vegetation removal or what will happen once
the vegetation is removed.
For the next steps, please determine if you will be clearing all the vegetation
in the buildable area or shown, or if will you be removing vegetation
selectively based on where you are putting the structure. Then, please make
the following changes to the diagram and resend it to me:
1. Mark where the current driveway is located. Note: I suggest checking
with the Town to make sure the existing driveway meets their
ordinances.
2. If you plan to selectively remove vegetation from some areas and then
fully remove vegetation in the area for the structure, please mark both
of those areas on the diagram.
3. If you plan to fully remove all vegetation, on the diagram, please mark
where you anticipate the structure and parking to go and where you
will be revegetating. Please also include what you will be revegetating
with i.e., sod, native grasses/flowers, a mix of native
grasses/shrubs/trees, etc.

be doing as possible. For example, will you be removing all trees or just trees
of a certain size? Will you be leaving the stumps or grinding them? If you
think fill will be needed in a certain area, please explain that and/or note

Essentially, you want to try and provide an overview of the project, so that
when the Town Board looks at your application, they have a clear idea of
what you are looking to do. Also, the permit would only cover the work you
describe, so for your own sake, you want to make sure you are describing the
full extent of the activities you plan to do.

I had some additional thought to share.
In terms of your Shoreline Grading Application
Can you also include a few sentences about what you are planning to do in
terms of clearing.. . .i.e. are you just removing trees, are you also adding
any fill or doing any dirt work that changes elevations/topography? When I
send your application to the Town of Bell for their recommendation, I like to
send a short description so they can understand the extent of the work. If you
already submitted the application, just send this description to me and I can
add it to your application packet.
In terms of developing your property overall
Here are some other things to consider:
1. If you are hoping to get in a conventional, gravity -fed drainfield or an
above grade system like a mound (rather than a holding tank), you
might want to talk to a plumber/soil tester before you start the
clearing. That way, you can make sure you leave a portion of the
property undisturbed for a soil test. I'm not sure how you'll be doing
the clearing, but if you bring on heavy equipment and compact the
soils and/or add fill anywhere, that can affect where a system can go.
There have been times when a property owner disturbs the best area
of their property for a system, and as a result, they have to go with a
holding tank when they could have had other options.
2. As you work on planning your property, I suggest familiarizing yourself
with Wisconsin's impervious surface standards. These are a state
regulation our office regulates. Keep in mind, impervious surface is
any compacted, hard surface that sheds water. So it includes roofs,
decks, asphalt, concrete, cement etc., but it also includes any dirt or
gravel that is compacted (by driving or parking or walking on it). As you
plan out where you want your driveway, parking areas,
barndominium, future cabin, etc. you'll want to keep in mind the
amount of impervious surface you are allowed. Many property owners
keep natural vegetation on some areas of their property to help meet
the impervious surface standards (since that is more cost effective
than clearing the area and then having to replant with native plants or
gr

Here's our impervious surface form. You don't need to include one with the
Shoreline Grading permit but you will for the barndominium or any other
structure you applyfor. Just as a future FYI, an application that requires an
impervious surface form has an additional $25 fee.
15% of your lot is 13,329.36 square feet of impervious surface that you are
allowed without a stormwater management plan or mitigation plan. This is
significantly less than entire buildable area which is approx. 52,223 square
feet. Essentially, the buildable area shows where you can place structures
on the lot, but the 13,329.36 is the total amount of impervious surface you
can have in that area (without a stormwater management plan or mitigation
plan; if you have questions about what these options entail, let me know).
I know this can be a Lot of information to take in, so feel free to ask questions!
There's a lot to consider when developing a rural property, and Lakeshore lots
have additional Layers to consider.

to manage lakefront properties to ensure a healthy shore that can be helpful
to review in the planning stage.

It was nice talking to you again today!
I marked approximately 300' from the water extending back with a green line.
I also drew another green line extended 63' from the centerline of the road. If
the structure is going between those green lines it would meet the road
setback, and you would not need a Shoreland Grading permit to do any
clearing. I drew the red line to show the approximate distance between the
green Lines.

If you want to clear outside of this area, if you can show me where on the
property you plan to do the clearing and the dimensions of this area, I can let
you know if a Shoreline Grading permit is needed. Alternatively, if you submit

part of the building of that structure, a separate Shoreline Grading permit
isn't needed.

Congratulations on purchasing property on Siskiwit Lake!
As we discussed on the phone yesterday, the Town of Bell is
responsible for driveway permits. Here is the Town's driveway
ordinance. Also, Land Records at Bayfield County assigns fire
numbers.
Based on our conversation and your current plans, I looked
into more specifics and found the following information.
Since you are not on on Lake Superior, you only need a Class A
Special Use grading permit if:

I've also attached the complete section from our ordinance on
Filling, Grading, Dredging, and Lagooning (Sec 13-1-24).
You should also be familiar with Sec 13-1-23 "Shoreland-
Upland Screening, Fencing, and Vegetative Management" (also
attached) which talks about managing vegetation along the
Lakeshore. In particular, the part on the vegetative protection
area and the viewing corridor are important for landowners:

If you are not grading or filling 1,000 square feet within 300 feet
from the Ordinary High Water Mark (OHWM), the first permits
you would need to build a pole barn with living quarters from
the County are a Land Use Permit and a sanitary permit.

For a LUP, a landowner or an authorized agent (like a
contractor) fills out and submits the application to our
department (either emailing it to
permits( 3bayfieldcounty.wi.gov, mailing it, or dropping it off in
person). I'm also attaching a LUP application information
packet. It gives examples of what is required, including a site
plan (see pg. 3), a floor plan (see pg. 4), and, since you are in
the Shorelands, elevations (see pg. 5). Once a LUP application
is submitted, I review the information and reach out to the
landowner with any questions. Then I visit the site to make
sure that the project meets the setbacks listed in the
application. If your building is within 300 feet of the OHWM,
you will also need to submit an Impervious Surface form.
For a Sanitary permit, landowners work with a licensed
plumber, and the plumber submits the sanitary permit
application to the department. You will need a valid sanitary
permit before we can approve the permit for pole barn with
living quarters and pressurized water. Many landowners
submit their LUP application and sanitary permit application
around the same time. Here is a list of licensed plumbers in
the area. Plumbers tend to have a lengthy waitlist in our area,
so it's a good idea to connect with them early on and get on the
waitlist.
As I mentioned another optional step some landowners take is
scheduling an on -site visit consultation. Here's a brief
description from our FAOs:
