Planning and Zoning Agency Kurt Kiehne & Marieke van Donkersgoed-Kiehne 77460 Old C Road Washburn, WI 54891 Phone: 715-209-0628 Email: wamco2022@gmail.com July 2, 2026 Bayfield County Zoning / Planning Department PO Box 58 Washburn, WI 54891 Re: Special Use Permit request— Residential use of commercial property (portion of Parcel ID# 17874) To whom it may concern We are writing to respectfully request a special use permit to allow residential use on a one -acre portion of commercially zoned property that is part of Parcel ID# 17874 in the Town of Grand View This one -acre parcel, currently being surveyed off by the seller, is located on County Highway D behind the former convenience store on State Highway 63. The convenience store has been closed for years, and the surrounding area has become unused and neglected. The properties to the east, south, and west of the proposed one -acre parcel are already residential with existing homes. Some of the owners are our friends and long-time residents. Our intention is to join and strengthen this existing neighborhood, extending the established residential character where future commercial use is unlikely. We love Grand View. It is a friendly, peaceful village on an excellent connective route, and we feel fortunate to have the opportunity to make our home here. Our plan is to build a single -level home that fits the scale and feel of the community. We believe our home will be an asset to the village, adding stable, year-round residents and helping to revitalize an underutilized property along Highway 63 and County Highway D. Like many people in our age group, we have been searching for a single -level home for years in a very scarce housing market. We have the means to build a high -quality, attractive home and garage on this parcel, with careful attention to landscaping and maintenance. By doing so, we will not only meet our own long-term housing needs but also help free up our larger family home elsewhere in Bayfield Countyfor a younger family who needs more space. This supports the natural flow of housing that has been stagnated nationwide and helps address local housing needs in a practical way. RecelveD JUL 022026 Planning a, Zon Co Agency Kurt Kiehne Our vision is to turn this currently unused and neglected area into something beautiful, cared for, and fully integrated into the surrounding residential neighborhood. We are committed to being good neighbors and active, supportive members of the Grand View community. We respectfully ask that you consider granting a special use permit so that we may proceed with this residential project on the newly surveyed one -acre parcel. We understand that the survey is in process and will result in a new parcel ID# and legal description, and we will promptly provide this information as soon as it is available. We are enclosing a site plan and are happy to provide any additional materials the board or zoning staff may require, and we are willing to attend any hearings or meetings to answer questions and listen to concerns. Thank you very much for your time and consideration of our request. We look forward to the possibility of investing in Grand View and making this property a vibrant, welcoming part of the village once again. Attachments: residence/garage in C SUP - Tax IDs 17873 & 17874; Kiehne App -Garage (1).pdf Marieke, You never gave the department the go ahead to issue permits within the appeal window, which is why they were not issued. The department asked whether you wished to proceed during the appeal window, see attached email. You contacted the department and stated that Kurt and you would talk to determine whether it was appropriate to have us issue permits during the appeal window. Several emails were exchanged between the department and you, none of them included you giving the department the okay to issue the permits in the appeal window. We need this okay from you as you would be taking on the liability of starting the project prior to the appeal window closing. In the meantime, Kurt had stopped in the office and asked about revising the garage permit. I indicated that the scope of the change exceeded what the department could administratively grant approval for and explained that I would need to speak with the Planning and Zoning Committee Chair. I have a call scheduled with him this morning. The Chair could require you to seek a new Special Use Permit to increase the size of the garage. This will give the town and public an opportunity to weigh in and the request could be conditioned or denied if there is evidence to support not allowing it. The permit is what gives you the right to start construction. The language you highlighted in red below from a prior email only indicates that you had the option to have use issue permits. This is the same option you were given originally when we sent the decision letter. The department can understand where some confusion could have occurred, but this misunderstanding was not completely on the department. Given that you never followed up with the department regarding issuing permits during the appeal window and should have been waiting for the response from the Planning and Zoning Committee Chair, the department only feels that a partial waiver of the after -the - fact is appropriate. Typically, the after -the -fact fee is triple the original permit cost. Attached is the original garage permit. Please revise it to reflect your current plans and resubmit it. Note that the fee amount will change due to the size increase as the fee is based on a $0.20/sq. ft. calculation. Once the application is revised, the department will review and determine the appropriate after -the -fact fee that will be associated. Ruth, The department need not struggle understanding after my previous explanation. Again, we moved forward based on your answerto my question, suggesting we had the option to move forward if we were willing to take the risk. That, in combination with what you also verbally told both Kurt and me, that in all the years you've been in this role, you have not seen appeals afterthe town board and SUP commission had given the green light, gave us sufficient confidence in the process to take that risk. I fully understand that we need to follow the zoning rules and permitting instructions and we will continue to do so based on the information we receive(d). It disappoints me that you are falling back on small print in the letter and dismissing our phone conversation and email exchanges. We will do what needs to be done. I understand that your needs have not aligned with permitting timeframes required. However, this does not give you the right to proceed without permits. The decision letter, see language below that was included in this letter, indicated that construction should not begin until permits were received from our office.
