Attachments: residence/garage in C SUP - Tax IDs 17873 & 17874; Kiehne App -Garage (1).pdf Marieke, You never gave the department the go ahead to issue permits within the appeal window, which is why they were not issued. The department asked whether you wished to proceed during the appeal window, see attached email. You contacted the department and stated that Kurt and you would talk to determine whether it was appropriate to have us issue permits during the appeal window. Several emails were exchanged between the department and you, none of them included you giving the department the okay to issue the permits in the appeal window. We need this okay from you as you would be taking on the liability of starting the project prior to the appeal window closing. In the meantime, Kurt had stopped in the office and asked about revising the garage permit. I indicated that the scope of the change exceeded what the department could administratively grant approval for and explained that I would need to speak with the Planning and Zoning Committee Chair. I have a call scheduled with him this morning. The Chair could require you to seek a new Special Use Permit to increase the size of the garage. This will give the town and public an opportunity to weigh in and the request could be conditioned or denied if there is evidence to support not allowing it. The permit is what gives you the right to start construction. The language you highlighted in red below from a prior email only indicates that you had the option to have use issue permits. This is the same option you were given originally when we sent the decision letter. The department can understand where some confusion could have occurred, but this misunderstanding was not completely on the department. Given that you never followed up with the department regarding issuing permits during the appeal window and should have been waiting for the response from the Planning and Zoning Committee Chair, the department only feels that a partial waiver of the after -the - fact is appropriate. Typically, the after -the -fact fee is triple the original permit cost. Attached is the original garage permit. Please revise it to reflect your current plans and resubmit it. Note that the fee amount will change due to the size increase as the fee is based on a $0.20/sq. ft. calculation. Once the application is revised, the department will review and determine the appropriate after -the -fact fee that will be associated. Ruth, The department need not struggle understanding after my previous explanation. Again, we moved forward based on your answer to my question, suggesting we had the option to move forward if we were willing to take the risk. That, in combination with what you also verbally told both Kurt and me, that in all the years you've been in this role, you have not seen appeals after the town board and SUP commission had given the green light, gave us sufficient confidence in the process to take that risk. I fully understand that we need to follow the zoning rules and permitting instructions and we will continue to do so based on the information we receive(d). It disappoints me that you are falling back on small print in the letter and dismissing our phone conversation and email exchanges. We will do what needs to be done. If charging us a triple fee is your solution to making it right, so be it. We continue to appreciate you and the department's assistance. My hope was to connect with him this week. I told Kurt there was no guarantee that the size change could be administratively approved. That it could require a new Special Use Permit. I understand that your needs have not aligned with permitting timeframes required. However, this does not give you the right to proceed without permits. The decision letter, see language below that was included in this letter, indicated that construction should not begin until permits were received from our office. Please note, receiving approval from the Planning and Zoning Committee at the meeting, does not authorize the beginning of construction or land use, you must first obtain individual land use application(s) / permit(s) from the Planning and Zoning Department. Terms and conditions of your permit shall be binding upon, and inure to the benefit of, all current and future owners of such property. The department is struggling to understand why you proceeded with construction without permits. At a minimum, the department may have to assess triple fees for the garage project given that construction began without permits. MLS 15 Ruth Hulstrom From: Marieke van Donkersgoed <mariekevandonkersgoed@gmail.com> Sent: Wednesday, September 30, 2026 1:20 PM To: Ruth Hulstrom Cc: Kurt Kiehne; Scott Roush Subject: Application revisions Attachments: Revisions for GARAGE Land Use Permit Application.pdf Hi Ruth, We are thankfull Kurt found the email he missed. It came when you and I were communicating a lot through my email address, which was not copied. In any event, we were not aware that the question was hanging out there waiting for a reply and apologize if that caused additional confusion all around. We went through the original application. Since it was submitted we became the owners, the parcel was surveyed, and given a new legal description and Tax ID#. The survey revealed that the lot lays farther east than was assumed when we purchased. We have not changed the locations of the proposed building sites for the garage, but the setbacks have changed. Please see attached all the changes for the form highlighted yellow, as well as a revised site plan with the new measurements. If anything else is needed, please let us know. We took forward to the permit, and would like to pick it up when ready since the mail takes forever these days. Thank you, Marieke On Wed, Sep 30, 2026 at 12:05 PM Ruth Hulstrom <ruth.hulstromCcbavfieldcoungr . i o > wrote: Marieke, Please see attached pdf. The department is the Planning and Zoning Department. The Planning and Zoning Committee Chair and I talked this morning. He felt comfortable allowingyou to revise the application and increase the size of the garage given that there was no opposition to your original request and the additional development is in a more densely developed area. The department will await the revised land use permit application for the garage. In the meantime, we will issue the Special B Permit. Please let us know if you have any questions or concerns.
