I agree with your concerns and thoughts minimizing stormwater inputs into public waters. The Contractor recommended having a specialized Site Preparation company assess and come to the site to scope the plan. See attached Document = Clark_StormwaterSiteWork.pdf If there was a need for retaining walls on the lakeside I would have KV Build assist with that work. At this time Tracy it was not planned but if becomes a need I would address it maintaining 75 foot setback. ImperviousSurfaceForm_Clark.pdf attached (I did include the CMS to cover the Legal Description section of the Form as it it lengthy) The Septic information really is concerning the discrepancy of 1 Bedroom verses 2 Bedrooms. I received the 'Private Sewage System Inspection Report' &'Sanitary Permit Application' legal documents when purchased the property from Dan Waterhouse stating 2 Bedrooms. Could you please review the attached Clark_SepticDocs.pdf file I am referencing. Again, thanks for working on this process Tracy! At any time if you have more questions or I can provide other information let me know. Have a good day! Bernard Clark, ------ Original Message ------ Received: 03:24 PM CDT, 09/30/2026 From: Tracy Pooler v> To: Bernard Clark <brnardjk@.us.net> Subject: Land Use Permit needs Bernard, I was at your site yesterday and I have a couple questions/needs before permit issuance. * There is a low spot in the center of the new dwelling location that may need to be filled. Are there plans for retaining walls on the lakeside to address this. If so what is the plan and will it meet the 75 foot setbacks. * There is a fair amount of drop from the road to the garage site, has stormwater been addressed to minimize inputs into the public waters? Plans please * Because of its location near the water an Impervious Surface Calculation Form is required - see attached. Note the gravel driveway to the north of the dwelling is to be classified as impervious surface. * The septic information that I can find for this property is attached. It indicates that it was designed for a 1 bedroom dwelling. To have a second bedroom in the new structure the septic will need to be addressed. Please note that the septic map does not include the well alongside of the road. There is a 50 foot setback for the septic drainfield from any wells. Tracy, may I get your land use permit approval if I sign the "A flows and loads affidavit recorded on the deed limiting occupancy to two people will be required" but knowing this work would occur as part of the construction project. Meaning, I would then like an Amendment to the Affidavit to be filed stating the septic system was modified to meet 2 Bedroom specifications upon your inspection? See below Tony's review. Thank you for the information. Before we assume that the existing septic system will require modification solely based on the proposed second bedroom, we would like to further evaluate the existing system's approved capacity under Wisconsin SPS 383. SPS 383.43(3) provides more than one method for determining estimated daily wastewater flow for a dwelling. In addition to the standard bedroom -based calculation, SPS 383.43(3)(b) allows a detailed wastewater -flow estimate based upon per -capita occupancy or usage of the dwelling or per -function occurrence within the dwelling. Additionally, SPS 383.03(1)(c) appears to require modification of an existing POWTS when a proposed building alteration results in wastewater flow or contaminant loading beyond the capabilities of the existing system. With that in mind, could we first determine the permitted/design capacity of the existing POWTS and whether the proposed use can be demonstrated to remain within that capacity under SPS 383.43(3)(b)? If the existing system does not have sufficient capacity after that evaluation, we understand that modification or replacement may then be required. For now, we would like to address the POWTS capacity question separately from the well setback issue Regarding the existing well, we understand the concern with the required separation between a private well and a soil absorption system. Our understanding of Wisconsin SPS 383 is that the POWTS setback table refers well separation requirements to Wisconsin DNR Chapters NR 811 and NR 812. For a private residential well and a soil absorption unit receiving less than 8,000 gallons per day, the applicable minimum separation is generally 50 feet. Before determining that the existing POWTS needs to be modified based upon the well location, however, we would like to confirm the actual field conditions. The existing septic documentation apparently does not identify the existing well along the road, so we believe the well location and the limits of the existing gravity soil absorption field should first be verified. If the well is at least 50 feet from the existing soil absorption field, it would appear that the required separation is maintained. We would therefore like to verify the actual well -to -absorption -field distance before determining whether any modification to the existing POWTS is required. Separately, we are reviewing the design -flow question associated with the proposed second bedroom under SPS 383. Occupancy exceeding this number may constitute a violation of State and County private sewage system regulations. The Governmental Unit may issue orders to correct and/or may commence legal action if at any time it is determined that occupancy exceeds the maximum listed number contrary to this agreement. 2. It is understood when the existing POWTS fails it shall be replaced with a properly sized and code compliant private sewage system.
