The department understands that the development process can be complex and we do our best to guide each individual property owner through the process. Noted that you had attempted to file a Land Use Permit earlier but were told a Conditional Use Permit would be needed first. Given the location of the proposed second residence a Conditional Use Permit was needed first, but the department also reiterated 7/21/2026 that a Land Use Permit would need to be filed, see image below. Let Tracy, ce'd on this email know if you have any questions related to filling out this application. As it relates to the CUP application you submitted, we can get it on the August 201h Planning and Zoning Committee meeting agenda but given the layout and existing to is wondering whether the CUP Is needed. Note Baylield County Sec. 13-1-33(a) that allows a second residence without a CUP If you can show that each residence could be placed on a lot meeting the minimum zc requirements. Sec. 13.143 Maniple sbueares. r•.+nr r•ne.m, Each development project can be just a little different and require the property owner to work with our office and other agencies, such as the Uniformed Dwelling Code (UDC) inspector, State commercial building inspector, or Department of Natural Resources (DNR). Unfortunately, we do not know all Federal, State, and town regulations that might apply to each project. Our department is responsible for overseeing private sanitary, floodplain, shoreland-wetland, nonmetallic mining reclamation, land divisions, and general zoning ordinances. It is the property developer's responsibility to educate themselves as to what approvals are needed for their project. Our job is to help property developers and owners understand and meet our regulations. If we are aware that other regulations may apply, we recommend that property developers and owners contact those other agencies. Land Use Permits for one and two-family dwellings are conditioned with the following: "A Uniform Dwelling Code (UDC) Permit from the local contracted UDC Inspection Agency must be obtained prior to the start of construction" Unfortunately, because you started without a Land Use Permit, this condition was unable to be communicated. The department cannot find justification to waive the entirety of the after -the -fact fee because the property owner and contractor did not do their due diligence to obtain the approvals they needed prior to start of the construction. A contractor doing work on a one- or two-family dwelling requires certain State qualifications, and they should know what approvals are needed prior to starting construction. We are willing to only require double after -the -fact fees for the project given your inexperience with the development process. In the future, we would encourage you to connect soonerto determine what permitting or approvals may be needed for a project.
